On 8 December 2015, B Chu J granted leave to the plaintiff to discontinue her claim against the defendant on terms as to costs and an undertaking of the plaintiff not to commence proceedings for the same subject matter, and ordered judgment be entered against the plaintiff in respect of the defendant’s counterclaim with costs of the entire action to the defendant.
