1.This is the summary assessment of the defendant’s costs pursuant to the direction of this Court in our judgment dated 24 August 2016 at [24].

2.In the statement of costs, the defendant’s solicitors claimed a total amount of HK$68,205 as their profit costs.  In our view, the amount claimed in the following items is grossly excessive :

(1)  C1 - attendance on client

(2) C3 - attendance on counsel
$17,000
 
(3)  D1 - preparation of documents  
$28,500
 
(4)  D2 - perusal of documents
$6,000
 
(5)  D3 - Law research & etc.   
$4,000
 

3.Having regard to the nature and complexity of the work involved, they are taxed down to the following sums respectively :

(1)  C1 -  $4,000
(2)  C3 -  $4,000
(3)  D1 -  $8,000
(4) D2 -  $4,000
(5) D3 -  $2,000

4.The total profit costs allowed is HK$26,705.00.

5.We find counsel’s fee of $30,000 reasonable and allow it in full.

6.The total costs allowed by us on this summary assessment is $56,705.00.
