HCCC 364/2018 [2019] HKCFI 2083 IN THE HIGH COURT OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION COURT OF FIRST INSTANCE CRIMINAL CASE NO 364 OF 2018 -----------------
-----------------
-------------------------------------------------- Transcript of the Audio Recording of the Sentence in the above Case -------------------------------------------------- COURT: Defendant is convicted of trafficking in 135 grammes of ‘Ice’ after trial. He was carrying the bag of drugs when encountered by police officers and he walked away in quick pace. But when he was eventually caught up, he threw the bag of drugs in his hand onto a slope. He is now aged 44, has no previous for trafficking in dangerous drugs but back in 2013, he has a conviction for possession of dangerous drugs and resisting a police officer for which he received a total of 10 months’ imprisonment, and he was last discharged from prison on 18 February 2014. Then in 2015, he committed a gambling offence for which he was fined $500. Counsel told me that he worked for a construction company and an engineering company with stable income and is married with three children. Trafficking in between 70 to 300 grammes of ‘Ice’ attracts 11 to 15 years’ imprisonment. So for the present amount of 135 grammes, I adopt a starting point of 12 years and that is the sentence that I pass. |
