1. This is an appeal arising from the summary judgment entered against the 1 st defendant and the strike-out of his counterclaim. The plaintiffs’ claim is for payment of the sum of RMB 270 million under a written settlement agreement. The central issue is whether the alleged oral agreement between the parties raised by the 1 st defendant as a defence is incredible, as the Master and the Deputy Judge held below.
