Order by Deputy High Court Judge K.W. Lung: Leave to apply for Judicial Review be dismissed. Observations for the Applicant: THE APPLICATION 1.The applicant is an illegal immigrant. He lodged non-refoulement claim with the Immigration Department and was rejected by the Director of Immigration. He appealed to the Torture Claims Appeal Board (the “Board”) and, by the Board’s Decision, his appeal was dismissed by the Board. 2.The applicant filed Form 86 on 1 August 2019 for application for leave to apply for judicial review of the Board’s Decision. 3.The applicant filed an affirmation dated 3 May 2022 to say that he wanted to withdraw his application as his creditor did not pursue him anymore and he wanted to go back home. 4.In accordance with the Court of Appeal in AW v. Director of Immigration and William Lam CACV 63 of 2015, 3 November 2015:
