Application for Leave to Apply for Judicial Review NOTIFICATION of the Judge’s decision (Ord. 53 r. 3) Following;
Order by Deputy High Court Judge K.W. Lung: Leave to apply for Judicial Review be dismissed. Observations for the Applicant: 1.The applicant is an illegal immigrant by staying in Hong Kong without permission and he lodged a non-refoulement claim with the Director of Immigration (“the Director”). The Director rejected his application and he appealed to the Torture Claims Appeal Board (“the Board”). Having considered his evidence, the Board, by its Decision (“the Board’s Decision”), rejected his appeal and affirmed the Director’s Decision. 2.The applicant filed Form 86 on 28 October 2019 to apply for leave to apply for judicial review of the Board’s Decision. 3.The applicant appeared before the Court on 15 November 2023 and said that he wants to go back to his country. 4.The Court explained him that his application would be dismissed and the consequences of the dismissal. He confirmed that he understood and his decision again. 5.There is nothing outstanding in this action. 6.In accordance with the Court of Appeal in Re Manik Md Mahamudun Nabi [2022] HKCA 471 at §19:
