Zhou Hui Ming obtained four arbitral awards against Sun Kwok Ping and Noxin from Shanghai Arbitration Commission in July 2024. After leave to enforce the awards was granted by this Court, the defendants sought to resist enforcement and frustrate the process by filing a summons to set aside enforcement which was withdrawn and then dismissed with indemnity costs due to lack of merit and tactical delays. Zhou applied for continuation of Mareva injunctions and appointment of interim receivers over defendants’ assets to prevent dissipation pending enforcement. The Court found real risk of dissipation supported by suspicious post-award share transfers without consideration, inadequate and incomplete disclosure, failure to cooperate with Special Managers, and conduct below commercial morality standards. The Court held that Mareva injunction continued, Zhang held shares as nominee for Sun justifying a Chabra injunction, and appointment of interim receivers was warranted for proper asset management and enforcement efficacy. Receiver powers were to be broad, and duration indefinite with liberty to apply for discharge. The costs for enforcement summonses were awarded against Sun parties on a taxing basis. The Court emphasized the necessity of transparency and cooperation in enforcement proceedings and the utility of receivership to preserve judgment creditors’ interests when assets are opaque or mismanaged.
