判 決 書

1．第二答辯人的申請是如下列 ：

"(a) order made by this Honourable Tribunal dated 13th August 2001 be set aside/revoked;

(b) direction be given by this Honourable Tribunal to the Administrator of the Incorporated Owners of Mei Foo Sun Chuen - Stage III, Mr. Chung Pui-lam, that any intended General Meeting of the Owners of the Stage III of the Mei Foo Sun Chuen be stayed pending the outcome of the determination of the application to set aside the order in (a);"

2.2001年8月13日，審裁處頒佈下列的命令 ：

"3. The 2nd Management Committee of the Incorporated Owners of Stage III, Mei Foo Sun Chuen be dissolved;

4. Mr. Chung Pui Lam, Senior Partner of Messrs. Chung & Kwan, solicitors be appointed the administrator of the Incorporated owners of Stage III, Mei Foo Sun Chuen pursuant to Section 31 of Building Management Ordinance, Cap. 344, Laws of Hong Kong;

5. The administrator shall convene a general meeting of the Incorporated Owners of Stage III, Mei Foo Sun Chuen for election and appointment of a new Management Committee of the Incorporated owners of Stage III, Mei Foo Sun Chuen;

6. The appointment of the administrator shall expire after a period of 6 months from the date of this order or after the owners present at a meeting of the Incorporated owners of Stage III, Mei Foo Sun Chuen convened under the preceding paragraph appoint a new Management Committee or until further Order of the Court;"

3．2001年10月15日，本席批准第二答辯人加入為本訟案的答辯人。

4．本案的重點在於當申請人提出本案的申請時，第二答辯人是否仍未被解散或由另一個管理委員會所替代。假若在當時它仍然是存在的話，則本庭便無需委任管理人。

5．本席獲知管理人將於今日（2001年11月2日）召開業主大會以選出新一屆的管理委員會（即新的第二屆管理委員會）。如果大會選出新的管理委員會，但第二答辯人是依然存在屋邨便會有兩個管理委員會；這會令到屋邨的管理變得非常複雜。

6．基於上述的理由，本席將2001年8月13日所頒佈的命令的 第4、第5及第6項命令取消。就第二答辯人(b)項的申請，本席不會作出任何命令。
