1. The Applicant is a 41-year-old national of Vietnam who earlier in January 2019 illegally entered Hong Kong and was subsequently arrested and repatriated to Vietnam in February 2019 again sneaked into Hong Kong less than 2 years later on 3 January 2021, and was arrested by police on 4 January 2021. After she was referred to the Immigration Department for investigation, she raised a non-refoulement claim for protection on the basis that if she returned to Vietnam she would be harmed or killed
