________________________ REASONS FOR SENTENCE ________________________ 1.Both defendants are represented by counsel. They pleaded guilty to one joint count of burglary. As a matter of fact, on the day in question, together with the mastermind in the case, which is called Singh, both defendants broke open the warehouse and stole from therein more than 100 boxes of garment products. 2.A transportation vehicle was summoned, so that these stolen property were transferred to an alternative warehouse in a nearby area. The 1st defendant was involved in renting the alternative warehouse, and the 2nd defendant was involved in summoning the transportation vehicle. 3.Both defendants are grown up adults, they are of clear record in Hong Kong. There is clear sentencing authority in the Court of Appeal to this kind of offence (i.e. non-domestic burglary) where starting point is 2½ years’ imprisonment, which is 30 months. I accordingly adopt the same level of sentence. 4.The fact that both defendants were acting in concert with the mastermind is an aggravating feature. The sentence is therefore enhanced by 3 months. Both defendants pleaded guilty in a timely fashion and should therefore be given the full one-third discount. Eventually, each defendant is sentenced to 22 months’ imprisonment.
