This is an application by the Defendant, Furness Logistics (HK) Limited, for an order that all further proceedings in this action be stayed in favour of the Court at Rotterdam, the Netherlands, on the ground that the contract which is the subject of this action contained an exclusive jurisdiction agreement. Clauses 21 and 22 of the Terms and Conditions of Bill of Lading, No.KKA040, pleaded in the Amended Statement of Claim, read as follows :-
