J U D G M E N T

1.The petition in this matter was brought by the Bank of China (HK) Limited. Before the merger of banks, the petitioner was the Kwang Tung Provincial Bank Limited. The petition is based on the balance of a judgment debt in HCA No. 2485 of 2000 given on 31 March 2000. The balance outstanding is in the sum of HK$20,914,804.02.

2.A statutory demand was served on the company on 8 February 2001. The petition was filed on the basis that the statutory demand has not been complied with and the company is unable to pay its debt.

3.The company has not appeared by a solicitor and no notice has been received by the petitioner's solicitors of anyone intending to oppose the petition. In the circumstances, I make a winding-up order against the company and I order that the petitioner's costs be paid out of the assets of the company.
