1. The circumstances giving rise to Ray Chen's claim may be shortly stated. On 18 August 1998 Ray Chen began employment with IBM China/Hong Kong Limited (IBM) as a 'Senior IT Specialist'. His salary was $50,000 per month. It was a term of his employment that during the first six months of that employment he was on probation.
