1. I have before me an application to appoint an arbitrator pursuant to the provisions of s.12 of the Arbitration Ordinance Cap. 341. The agreement between the parties which contains the Arbitration Clause is dated 21st October 1986 and thus pre-dates the coming into force of the Model Law on 6th April 1990. This application, which would otherwise be considered under the Model Law regime for international arbitrations, falls to be considered under the domestic regime.
