____________ Coram: Hon Kwan J in Court Date of Hearing: 2 February 2004 Date of Judgment: 2 February 2004 ______________ J U D G M E N T ______________ 1.This is a petition to wind up Galore Construction Company Limited ("the Company") presented by its former employee Mr Tsang Wai Ping. The petitioner obtained an award from the Labour Tribunal against the Company on 24 June 2003 in the sum of HK$40,000.00. 2.Apart from the petitioner, the Company is indebted to three employees in the total sum of HK$82,000.00 under an award made on 14 July 2003 and to three employees in the total sum of HK$24,000.00 being the balance of an award made on 30 October 2002. A demand for the petitioner's debt was served on the Company on 29 September 2003. The petition herein was presented on 24 November 2003. 3.The Company is not represented today. I understand from the Director of Legal Aid that subsequent to the hearing before the Master, the Company has made proposals to pay the judgment debt to the petitioner and that the petitioner has declined to accept the proposals. 4.That being the case and as no ground of opposition has been advanced by the Company, I must make a winding-up order with costs to the petitioner.
