1. This is a claim against Wong Siu Hung (D1) for personal injuries sustained by the Plaintiff in a motor vehicle accident that occurred on 16 October 2004. D1 did not dispute the liability but contested that the Plaintiff should be 50% liable for the accident. It is noted that D1 was charged with and pleaded guilty to the traffic offences, contrary to s.38(1) of the Road Traffic Ordinance Cap 374 and Reg.50 of the Road Traffic (Public Service Vehicles) Regulations Cap 374D.
