1. The 2 nd Defendant obtained from the building manager of a housing estate a contract to cut the trees standing on the hillside adjoining the estate. The whole the work was sub-contracted to the 1 st Defendant who employed the Plaintiff as one of his workers. He was injured while in the course of his employment. Disputes as to employees’ compensation has been resolved. The Plaintiff is now seeking damages for common law negligence against both defendants.
