This is an appeal by the 1 st defendantsin the Consolidated Actions against the decision of Master de Souza on 24 September 2009 dismissing the 1 st defendants’ application for specific discovery against a non-party and ordering that the plaintiffs and the non-party shall have the costs of the application, including any costs reserved in respect thereof, with Certificate for Counsel, against the 1 st defendants to be taxed, if not agreed, on full or indemnity basis.
