1. 本案牽涉位於新界元朗文安齋祖〔下簡稱“ 該祖 ”〕。該祖成員指曾經先後擔任該祖值理職務的兩名成員，即第一被告人文興洪〔下簡稱“ 興洪 ”〕和第二被告人文錦輝〔下簡稱“ 錦輝 ”〕，違反傳統習俗慣例，沒有交代該祖地租收入和開支帳目、分派丁錢、及交出有關記錄和文件，遂提出本訴訟。
