1. This is a trial of an action arising out of a contract between the plaintiff as buyer and the defendant as seller of a quantity of scrap metal. The plaintiff claims it has made full payment in respect of the two shipments that have been made under the contract but that, in breach of contract, the defendant has failed to make delivery of the second shipment. The defendant maintains that full payment has not been made under the contract and counterclaims the balance of the price.
