1. 2008年8 月13 日，申請人樊先生駕駛貨櫃車，把一個空貨櫃從茶果嶺和興碼頭送往天水圍的另一個貨櫃場。到達天水圍貨櫃場後，樊需要把貨櫃打開供貨櫃場的工作人員檢查。在打開貨櫃期間，樊因爲要擧高手觸及離地6尺高的門柄和門鎖，及要用力把貨櫃門打開，因而扭傷了背部。
