Attempted theft (企圖盜竊罪)

Reasons for Sentence

--------------------------

1.You have pleaded guilty to one count of attempted theft. Facts revealed that on 7 September this year, at around 1.30 pm, at a footbridge near Block 13, Lower Ngau Tau Kok Estate, Kwun Tong, you were stopped by a police officer when you attempted to pick the pocket of a woman. After a brief struggle, you were subdued and arrested by the police officers.

2.As to your background, it seems that since you came to Hong Kong in 1981, you started to commit one kind of offence or another until recently. You have a total of 32 previous convictions, out of which 16 involved dishonesty and 5 of them were pickpocket.

3.There is clear guideline for this kind of offence, that is, immediate custodial sentence is a must. In your case, your only mitigating factor is your plea of guilty. In this case, I will take 18 months as the starting point. Because of your plea, I reduce it to 12 months.
