of the Sentence in the above Case
-----------------------------------
COURT: The accused, you stand convicted on one charge of trafficking in a dangerous drug. You have pleaded guilty in the Magistrates’ Court and have been committed to the High Court for sentence.
The quantity of drugs involved is 1,003.42 grammes of a mixture containing 555.91 grammes of heroin hydrochloride.
You have imported the drugs into Hong Kong from abroad.
All things considered, I adopt a starting point of 17½ years and enhance it by 1 year, making a total of 18½ years.
I have taken into account everything urged in mitigation on your behalf. You have pleaded guilty; you have no previous conviction; and you, not being a local person, would find being in prison here even harder than if you were a local person.
I take all of these matters into account in your favour, and I shall give you a slightly more than one-third discount, reducing the starting point to one of 12 years’ imprisonment.
You are therefore sentenced to 12 years’ imprisonment.
