Reasons for Sentence

---------------------------

1.Defendant, stand up, please. You have been convicted after trial of two offences of robbery contrary to section 10 of the Theft Ordinance Cap.210 Laws of Hong Kong.

2.This was a joint enterprise between yourself and an unknown person who approached two young men at the basketball court of Yiu Foo House, Tin Yiu Estate in Tin Shui Wai at around 8 o’clock at night.  In the course of this robbery one of the victims was kicked in the back, knelt on and punched in the back and head.  The victims were demanded to surrender their mobile phones as either yourself or the wanted person told the victims that they were suspected of beating up one of his followers.  Upon fear of being further assaulted both victims surrendered their iPhones. 

3.You are 24 years of age and have a number of previous convictions including convictions for theft, assault with intention to rob and possession of dangerous drugs.  This was loutish, cowardly behaviour by yourself and your co-assailant which fortunately did not result in any serious injuries to either victim but they, of course, lost their iPhones in the process.  Any sort of robbery is serious.  The present case has undertones of triad-related behaviour and I am satisfied that 3½ years’ imprisonment is the proper starting point. 

4.You are sentenced to 3½ years’ imprisonment on each charge which I order to run concurrently with each other.
