1. There are three defendants in this case. They are charged with the following offences. D1 is charged jointly with D2 with a charge of conspiracy to defraud, Charge 1. They are also jointly charged with two charges of false statement by company directors, contrary to section 21 of the Theft Ordinance. These are Charge 2 and Charge 3 and both are laid as alternative charges to Charge 1.
