J U D G M E N T

Hon Godfrey JA :

1. After some initial hesitation, we are satisfied that an appeal by the unsuccessful plaintiff here does lie as of right and we shall give leave to appeal accordingly pursuant to the provisions of the Hong Kong Court of Final Appeal Ordinance, Cap. 484, section 22(1)(a).

2. We will therefore make an order in the terms of the minute placed before us today.
