Kindly note the following amendment in the Judgment of the above case handed down by Deputy High Court Judge Coleman SC on 22nd October 2012:-

“1) Page 8 para. 28 between the lines L & M, the word ‘extent IVA’ should read as ‘extant IVA’;

2) Page 11 para. 38 between the lines F & G, the word ‘improved arrangement’ should read as ‘approved arrangement’;

3) Page 11 para. 38 line G, the word ‘the rules Notice of’ should read as ‘the rules had notice of’;

4) Page 12 para. 42 between the lines E & F, the word ‘a debtor there as the necessary lockers’ should read as ‘a debtor there was the necessary locus’; and

5) Page 14 para.55 line S, the word ‘unlikely to want to present position’ should read as ‘unlikely to want to present a petition’.
