Li Yat Choi v. The Queen

IN THE SUPREME COURT OF HONG KONG (APPELLATE JURISDICTION) CRIMINAL APPEAL NO. 246 OF 1973 ________________________
________________________ Coram: Huggins, J. ________________________ JUDGMENT ________________________ 1. The Appellant pleaded Guilty to unlawful possession of dangerous drugs. He was found with one small packet and was sentenced to six months’ imprisonment. It is against that sentence that he appeals. 2. He has a number of previous convictions for dangerous drugs offences – going back to 1959 – but it is true, as the Appellant has urged before me, that he has not been convicted for nearly three years. Although the magistrate does not say so, I think he must have taken that into consideration in imposing a sentence of only six months. It is impossible to say that this sentence is manifestly excessive and I cannot interfere. The appeal is dismissed. 26th April 1973. |
