of the Sentence in the above Case
---------------------------------
COURT: The accused, I have taken into account everything said on your behalf. The most serious thing about this robbery, and it is an extremely serious thing, is that in order to carry it out, you not only threatened the victim with a syringe of what you made her believe was AIDS infected blood, you actually stabbed her in the arm with that syringe.
Mercifully, the HIV test carried out on her afterwards proved negative. But she must have undergone the most terrible agony of anxiety until then. Your actions in carrying out this robbery were extremely cruel. This kind of behaviour must be firmly deterred.
The only real mitigation available to you is your plea of guilty. For that you will receive a one-third discount.
All things considered, I adopt a starting point of 12 years. Discounting that by a third, I sentence you to 8 years’ imprisonment.
Please refer to CACC95/2014 for the relevant appeal(s) to the Court of Appeal. |
