This is a medical negligence claim against the Fanling Occupational Health Clinic (“the Clinic”), which is a government clinic established and managed by the Commissioner for Labour of the Hong Kong Special Administrative Region. The Secretary for Justice, for and on behalf of the Commissioner for Labour, is being sued by virtue of section 13 of the Crown Proceedings Ordinance and section 18 of the Hong Kong Reunification Ordinance.
