--------------------------------- Transcript of the Audio Recording --------------------------------- COURT: The defendant, aged 50, of a clear record with a young son aged 3, was stopped and searched by police officer at about 2 am in the morning in Mong Kok and found to be in possession of drugs. He has been found guilty after trial of possessing those drugs for the purpose of trafficking. The drugs were 27.32 grammes of a crystalline solid containing 26.52 grammes of “ice”. Whilst he said under caution that he had part of those drugs for his own consumption, in this case, all the drugs were wrapped in one packet and so there was no clear discernable amount to show a significant amount was for his own consumption. Given the offence happened on 24 January this year, the tariff laid down in Ching Kwok Hung is still good for this case, namely 10 to 70 grammes of “ice”, 7 to 10 years’ imprisonment. I adopt a starting point of 7½ years and given his physical handicap and poor health, I knock half a year off and he goes to prison for 7 years. |
