This is the plaintiff’s application by summons filed on 16 May 2014 (the “summons”) for an order that summary judgment be entered against the defendant under Order 14 rule 1 of the Rules of District Court, further or in the alternative for certain questions of law to be determined by the court pursuant to Order 14A, rule 1 of the Rules of District Court. At the conclusion of the hearing, judgment was reserved which I now give.
