中紀投資有限公司 Centre Chase Investment Limited v. 青山道國際工業大廈業主立案法團 the Incorporated Owners of Castle Peak Road International Industrial Building and Stl Company Limited
[2026] HKCFA 26FACV 2/202618 JunCites 25 casesProperty / Land

Castle Peak Road International Industrial Building is a multi-storey industrial building in Hong Kong whose owners formed a corporation under the Building Management Ordinance (Cap 344) ('the IO'). STL Company Limited, the owner of Unit 9A, installed several mock window frames on the external wall of its unit without prior approval from the management committee. The frames had no openings and were installed for feng shui purposes; though initially unauthorised under the Buildings Ordinance, they were subsequently regularised under the Building (Minor Works) Regulation and a certificate of compliance was issued. The appellant, Centre Chase Investment Limited, owner of Unit 2A, objected in April 2017 to the installation on various grounds including a breach of Clauses 10(e) and (g) of the Deed of Mutual Covenant and s.34I of the Ordinance. In July 2017, the management committee passed a resolution approving the existing non-structural facilities on the external walls (including the Window Frames and air-conditioner supporting frames) until future repair of the external walls, and a general meeting in April 2018 supported this stance by a 75.7% majority.
