New judgments

On 8 May 2026, this Court gave a judgment (“ the Judgment ”) dismissing the Defendant’s application for leave to appeal against the Order of Harris J dated 3 November 2025, by which the Judge dismissed the Defendant’s application for him to recuse himself from the substantive hearing of the Plaintiff’s Originating Summons seeking an order that the Defendant be committed for contempt of court.

本判案書處理兩名被告人曹綽芝女士 (「 曹女士 」) (CAMP 19/2026) 和關偉建先生 (「 關先生 」) (CAMP 20/2026) 各三項申請，分別為2026年1月提出之上訴許可申請、暫緩執行申請，以及他們於2026年5月提出之另一上訴許可及緊急暫緩執行申請。

This is the applicant’s appeal against the order of Deputy High Court Judge To (“ the Judge ”) dated 1 August 2025 ( [2025] HKCFI 3249 ) (“ the EOT Decision ”), refusing to grant extension of time to the applicant to appeal against the Judge’s earlier decision dated 12 June 2025 ( [2025] HKCFI 2441 ) (“ the Leave Decision ”).

On 4 March 2026, the applicant filed a Notice of Motion to apply for leave to appeal to the Court of Final Appeal against this court’s judgment of 23 February 2026 (“ the Judgment ”) ( [2026] HKCA 135 ). In the Judgment, we dismissed the applicant’s appeal against the decision of Deputy High Court Judge KW Lung (“ the Judge ”) dated 8 December 2025, by which the Judge dismissed his application for leave to apply for judicial review ( [2025] HKCFI 5764 ).

On 24 March 2026, the applicant filed a Notice of Motion to apply for leave to appeal to the Court of Final Appeal against this court’s judgment of 24 March 2026 (“ the Judgment ”) ( [2026] HKCA 437 ). In the Judgment, we dismissed the applicant’s appeal against the decision of Deputy High Court Judge KW Lung (“ the Judge ”) dated 8 December 2025, by which the Judge refused his application for leave to apply for judicial review ( [2025] HKCFI 5755 ).
