Emagist Entertainment Ltd v. Nether Games (Hong Kong) Ltd and Others
[2026] HKCA 1615CACV 160/202228 AugCites 6 casesCivil Procedure

Emagist developed and published online, web, social and mobile games, while Mr Boniface Lee Shiu Yin and ARTS were involved in creating Ninja Saga, a Facebook online role-playing game. In August 2012, the ART creators, together with CHENG ERIC TAK KWONG, removed the Game’s source code from Emagist’s workstations and migrated it to NETHER GAMES (HONG KONG) LIMITED’s office, interrupting the Game and causing it to lose popularity. Emagist estimated a revenue loss of about $3.8 million and commenced HCA 1659/2012, asserting copyright ownership and claims including copyright infringement, trespass to chattels, conversion, detinue, breaches of employment contracts, confidentiality and fiduciary duty, and acts injurious to Emagist. After trial, the judge rejected an alleged oral partnership, found that the ART defendants were employees who wrote the relevant code and databases, held that Emagist owned the copyright, dismissed the counterclaims, and ordered the ART defendants to pay US$455,928.39 plus interest. ARTS and Nether then appealed, and the Respondents sought security based on unpaid taxed costs and evidence that the Appellants lacked substantial assets.
