1. This is an appeal from an order of Nguyen, J. made on 24 April 1998. The parties to the proceedings before the judge were one Cheung Yuet Kiu, the plaintiff, New Fund Development Limited, the defendant (which I shall call "the purchaser") and Chung Tim Fat, the third party (whom I shall call "the vendor").
