1. The parties having undertaken by their respective counsel to file today consents to this matter being dealt with today by two judges of this court, we will proceed to do so.

2. But, as there are issues in the action still to be decided, we think it better to recall the costs order nisi pronounced on 4 July 2000 and to make no order at this stage as to the costs of the action to date. We consider that the resolution of the question as to how those costs ought to be provided for can more conveniently be left until after the conclusion of the action. We will, therefore, remit all outstanding questions in the action, and all questions as to the costs of the action, for determination by the Court of First of Instance. The costs of today will be costs in the action.
