IN THE DISTRICT COURT OF THE

CRIMINAL ACTION NO 736 OF 2016

  HKSAR
  V
  SINGH GURMAIL (D2)

---------------------------------

Before: Deputy District Judge Don So
Date: 28 February 2017 at 2:41 pm
Present: Mr Ian Polson, Counsel on fiat, for HKSAR
Mr Oliver Howell Davies, instructed by Francis Kong & Co, assigned by the Director of Legal Aid, for the 2nd defendant
Offence: [1], [2] & [4] Burglary (入屋犯法罪)
[3] Attempted burglary (企圖入屋犯法罪)

--------------------------------------

REASONS FOR SENTENCE

--------------------------------------

On the last occasion, I have passed a sentence in a total of 30 months imprisonment on you, but there was an oversight on my part. In fact, you on that day were already serving a sentence of 4 months in the case of KCCC 575/2007. I was told that that case is a charge of going equipped for stealing. The date, the time and the place of that offence are different from the charges that you are sentenced on by this court. In principle, all the sentences, 30 months, will have to run totally consecutive to those 4 months. But having considered the totality principle, I order that 29 months out of the 30 months I passed on you in this case is to run consecutive to the 4 months’ imprisonment in the KC case.
