Hon Chu JA (giving the Judgment of the Court):

1.By judgment handed down on 18 April 2018, this Court refused to give leave to the applicant to appeal out of time against Deputy High Court Judge Woodcock’s decision given on 23 February 2018, by which the applicant’s application for leave to apply for judicial review was dismissed.

2.On 23 April 2018, the applicant filed a Notice of Motion applying for leave to appeal to the Court of Final Appeal against this Court’s Judgment.  On 2 May 2018, the applicant lodged with the court a written submission in support of the Notice of Motion.

3.Section 14AB of the High Court Ordinance, Cap. 4 provides that no appeal shall lie from a decision of the Court of Appeal as to whether or not leave to appeal to it should be granted.

4.The applicant has no right to appeal against this Court’s refusal of leave to appeal out of time against the Deputy Judge’s decision.

5.Accordingly, the applicant’s Notice of Motion is dismissed.
