This is the judgment of the court on appeals relating to an order as to costs made by Barnett J on 13 March 1998 after the conclusion of a consolidated action in which the judge had given judgment on 25 March 1997. In that judgment, the judge had convicted the 1st and 5th defendants of fraudulent misrepresentation and had acquitted those, and other, defendants, of a charge of fraudulent trading in relation to the affairs of a partly owned subsidiary of the 1st defendant.
