1. Having considered the respondent’s written submissions and parties’ correspondence, we agree with the parties’ common position that costs of the appeal should follow the event, which means that the respondent shall have the costs. We further accept the respondent’s submission that a certificate for two counsel is warranted in the particular circumstances of the appeal.
