Having considered the respondent’s written submissions and parties’ correspondence, we agree with the parties’ common position that costs of the appeal should follow the event, which means that the respondent shall have the costs.  We further accept the respondent’s submission that a certificate for two counsel is warranted in the particular circumstances of the appeal.

Hon Poon JA (giving the Decision on Costs of the Court) :

1.Having considered the respondent’s written submissions and parties’ correspondence, we agree with the parties’ common position that costs of the appeal should follow the event, which means that the respondent shall have the costs.  We further accept the respondent’s submission that a certificate for two counsel is warranted in the particular circumstances of the appeal.

2.We therefore order :

(1) Costs of the appeal be to the respondent, to be taxed if not agreed, with a certificate for two counsel; and

(2) The respondent’s own costs are to be taxed in accordance with the legal aid regulations.
