1.This is the second time the Applicant sought leave to appeal against the dismissal of his appeal on 6 August 2018. The Applicant’s first Notice of Motion filed on 20 August 2018 had been dismissed by the Court of Appeal on 18 January 2019 pursuant to an Unless Order of 10 January 2019.

2.It is an abuse of court process for the Applicant to file a second Notice of Motion on 13 November 2020.  As such, his second Notice of Motion should be dismissed.

3.In any event, having considered the second Notice of Motion, we do not find any questions of great general and public importance to be submitted to the Court of Final Appeal for determination.  The requirement for granting leave under Section 22 of the Hong Kong Court of Final Appeal Ordinance is not met.

4.For these reasons, the Notice of Motion of 13 November 2020 is dismissed.
