Permission to Appeal – Maintenance – District Court Ordinance s.63A – Reasonable Prospect of Success – Assets – Income – Self-represented – Costs. Male and Female parties both applied for permission to appeal a maintenance variation order made by Deputy District Court Judge Cheung Chi Wai. The Court applied s.63A of the District Court Ordinance (Cap 336) to determine whether there was a reasonable prospect of success or other reasons in the interests of justice. The Court found no reasonable prospect of success for either party's grounds of appeal. The Male Party's appeal grounds included property handling, current wife's living expenses, work capacity, insurance, daughter's expenses, and the Female Party's assets. The Female Party's appeal grounds included the Male Party's pay cut, asset assessment, her own assets and health, and unfairness of the maintenance order. The Court dismissed both applications for permission to appeal. As both parties were self-represented, no order was made as to costs.
