1. The Applicant is a 29-year-old national of India who last entered Hong Kong illegally on 12 January 2014 and was arrested by police on 18 November 2014. After he was referred to the Immigration Department for investigation, he raised a non-refoulement claim on the basis that if he returned to India he would be harmed or killed by his paternal uncle and cousins over a land dispute in their home village. He was subsequently released on recognizance pending the determination of his claim.
