However, the Petitioner has not progressed the petition for 10 months. The Petitioner had been informed that the court expected the Petitioner to attend this hearing in order to explain how he intends to proceed. He has not, I will, therefore, order that the Petition be dismissed. 2.I will order that there be no orders as to costs save that the Official Receiver’s costs, which I assess the sum of $5,300 be paid out of the Petitioner’s deposit. The balance of the deposit be paid to the Petitioner.
