HCCW 286/2019 [2021] HKCFI 1833 IN THE HIGH COURT OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION COURT OF FIRST INSTANCE COMPANIES WINDING-UP PROCEEDINGS NO 286 OF 2019 ________________
________________ Before: Hon Harris J in Court Date of Hearing: 21 June 2021 Date of Decision: 21 June 2021 ________________ D E C I S I O N ________________ 1.Master Lai has adjourned to me the amended petition which is dated 20 September 2019. It would appear that the Petitioner has consistently failed to attend recent dates fixed for the petition’s hearing. 2.A letter was sent by the Master’s clerk on 29 April 2021 notifying the Petitioner of this hearing and warning the Petitioner that if it failed to attend the court might dismiss the petition for want of prosecution. Neither the Petitioner nor the Company has attended today. Given the history of this matter, it seems to me that it is desirable and appropriate that the petition is dismissed for want of prosecution, which I hereby do. 3.I make no order as to costs save that the petition of the Official Receiver’s cost in sum of HK$5,300 be paid out of the Petitioner’s deposit and the balance returned to the Petitioner.
