1.The costs order made at paragraph 32 of the Decision of 8 June 2021 was an order nisi made under Order 42 rule 5B, no submissions on costs having been made at the hearing on 3 June 2021 when judgment was reserved and later handed down on 8 June 2021.

2.Having considered the written submissions filed on behalf of both parties, the order nisi is varied to provide for the costs of and occasioned by the Notice of Appeal filed on 22 December 2020 to be paid by the 1st Defendant to the Plaintiff, with certificate for one counsel and to be summarily assessed and paid forthwith.  Orders are also made in terms of paragraphs 1b and 2 of the draft order submitted by the Plaintiff.
