By the judgment of this Court (Lam VP, Yuen and Chu JJA)  handed down on 26 July 2021 [1] , we allowed the claimant’s application to vary the costs order nisi made on 11 June 2021 [2] , and ordered the defendant to pay the claimant the costs of the appeal in HCLA 22 of 2018. We further ordered the costs to be summarily assessed and gave directions for the lodgement of statement of costs and statement of objection.

1.By the judgment of this Court (Lam VP, Yuen and Chu JJA)  handed down on 26 July 2021[1], we allowed the claimant’s application to vary the costs order nisi made on 11 June 2021[2], and ordered the defendant to pay the claimant the costs of the appeal in HCLA 22 of 2018. We further ordered the costs to be summarily assessed and gave directions for the lodgement of statement of costs and statement of objection.

2.Despite our directions, the defendant has not lodged any statement of objection to the statement of costs lodged by the claimant.

3.Having considered the claimant’s statement of costs and taking a broad brush approach, we would summarily assess the claimant’s costs in HCLA 22 of 2018 at HK$80,000.
