1. The plaintiffs commenced the action below against three defendants. The 2 nd defendant is a Mainland company. Leave was granted for service of the writ on it out of the jurisdiction on the “necessary or proper party” ground. The 2 nd defendant applied to have the service on it set aside, alternatively for a stay of the action against it in favour of arbitration or on the ground of forum non conveniens .
