The Applicant is a 39-year-old national of Vietnam who entered Hong Kong illegally on 16 April 2016 and was arrested by police on 11 May 2016 for possession of forged identity card and illegally remaining in Hong Kong for which he was subsequently convicted and sentenced to prison for 15 months, during which he raised a non-refoulement claim with the Immigration Department on the basis that if he returned to Vietnam he would be harmed or killed by his creditor over his unpaid debts.
